The Child's Right to Nurse Human Rights Amendment Act of 2007

DC Code Ann. 2-1402.81 et seq.

This law, effective December 11, 2007, provides that a woman shall have the right to breastfeed her child in any location, public or private, where she has the right to be with her child. The law also specifies that an employer shall provide reasonable daily unpaid break periods, as required by the employee, so that the employee may express breast milk for her child. The employer must make reasonable efforts to provide a sanitary room close to the work area (and not a bathroom) where the employee can express milk. If a break period is already provided, the break period shall run concurrently with the break period already provided. If a break would create an undue hardship, the employer is not required to provide a break period.

History Note: This Bill was adopted on first and second readings on July 10, 2007, and October 2, 2007, respectively. Signed by the Mayor on October 17, 2007, it was assigned Act No. 17-132 and transmitted to both Houses of Congress for its review. D.C. Law 17-58 became effective on December 11, 2007.
