Certification of Copyright Compliance

Form to be used in those instances when a CUA Book Store order form is not being utilized.

The purpose of this certification is to reduce liability for the university and its faculty and staff regarding copyright compliance.  When a  CUA Book Store order form has not been used to seek copyright clearance, faculty and staff seeking to copy materials must make an independent judgment that there is no potential claim of copyright infringement with respect to the material the employee is submitting for copying.  Accordingly, the person submitting documents for copying certifies that he/she has determined that the document (check the applicable box):

wpe1.gif (870 bytes)     Is in the public domain.

wpe2.gif (870 bytes)     Falls within the "Safe Harbor Guidelines" for classroom copying.

wpe3.gif (870 bytes)     Falls within the statutory definition of fair use.

wpe4.gif (870 bytes)     Has been cleared by a copyright center and appropriate fees, if any, paid (attach proof).

wpe5.gif (870 bytes)     Is the original work of the party submitting the request and, if published in a journal, rights
          have been retained to make copies of same.
Or
wpe6.gif (870 bytes)     May be copied because permission has been obtained from the copyright holder
          (not always the author).

The CUA Copyright Guidelines are available for review at the copy center and in the Office of General Counsel, 280 Leahy Hall (extension 5142).  Assistance regarding copyright questions is available from the Office of General Counsel.

The university may decline to indemnify or defend an employee who willfully disregards the university's Copyright Guidelines.
