IV.  Copying of Works not in the Public Domain (and not licensed by CUA)

 

C.  Copyright Permission Checklist

 

Here is a checklist to follow when seeking to reproduce, prepare derivative works, distribute copies, publicly perform or publicly display material that may be protected under copyright law.

  • Is the work in the public domain?  If yes, then no permission is necessary.

  • Is the work licensed through CUA or the Consortium for the particular use in question?
    If so, then permission is not necessary.

  • If the work is not in the public domain or licensed,  may fair use be invoked instead of obtaining permission?
  • If the use does not fit within safe harbor guidelines, then perform a fair use analysis, as set forth in Section IV.B.3.

  • If you think that fair use may be appropriate but you are not sure, consult with the Office of General Counsel.

If it is determined that you willfully disregarded Copyright Guidelines, you might not be defended by the university if you are the subject of an infringement claim. If the work is not in the public domain, not licensed by CUA, and fair use does not apply, then you must obtain  permission from the copyright owner.
