Sense of Congress on Protection of Student Speech and Association Rights

Section 112 of the Higher Education Amendments of 1998 is a sense of Congress provision (not considered binding, but useful as guidance) concerning protection of student speech and association rights. In general, the provision simply speaks in favor of freedom of speech and association at institutions of higher education, and speaks against excluding students who exercise those rights. The provision is not to be construed as intended to discourage the imposition of official sanctions on students who willfully participate in the disruption or attempted disruption of a lecture, class, speech, presentation or performance scheduled or made under the auspices of the institution of higher education.
