U.S. Postal Service Mail Manual Standards

Final Rule on Eligibility Requirements for Certain Nonprofit Standard Mail Matter
 
On October 9, 2003 at 68 Fed. Reg. 58273 the U.S. Postal Service issued guidance on expanded eligibility for fundraising mailings at nonprofit mail rates. The rule amends 39 CFR Part 111 as follows:
Exception: effective November 13, 2003, this standard no longer applies to mailings by an organization authorized to mail at Nonprofit Standard Mail rates soliciting monetary donations to the authorized mailer and not promoting or otherwise facilitating the sale or lease of any goods or service. This exception applies only where the organization authorized to mail at Nonprofit Standard Mail rates is given a list of each donor, contact information (e.g., address, telephone number) for each, and the amount of the donation or waives in writing the receipt of this list.
This new rule will be of interest to to Institutions of Higher Education that contract out with for profits to solicit donations for the IHE, as the for profit entity engaged in soliciations for a non-profit can now use the lower non-profit standard mail rates. The new rule requires the  for profit entity doing these mailings to give the non-profit a list identifying all donors, including contact information and the amount of donation. Mailings that involve the sale or lease of goods and services are not covered under the exception.
